The APB gives the go-ahead to the expansion of the concession of the Real Club Náutico de Palma

The Administration Council approves continuating with the procedures to expand the concession periods.

The Administration Council of the Balearics Portuary Authority (APB), reunited yesterday December 10th in an ordinary session, has approved giving the authorization of temporary occupation (AOT) of transitional nature to the Real Club Náutico de Palma (RCNP). This measure will allow the club to keep developing their activity in the spaces that are currently occupied until the expansion of the period is formalized and the extension of the concessional title for a total of 20 years in execution of the sentence of the Superior Tribunal of Justice of the Balearics.

The measure guarantees the continuity of the service and gives full law coverage during the period in the APB completes the administrative procedures that come from the law error.

In addition, the Administration Council has agreed on not lodging the cassation appeal against the mentioned sentence, integrally assuming the content of the pronouncement of the TSJIB and making the execution easier. Fulfilling the law reslution, the APB will inmediatedly start the needed procedures to formalize the expansion of phases and the extension of the concessional title of the RCNP.

In 1978, the Real Club Náutico de Palma was given the management and exploitation contract of the area destined to sports sailing in the dock of San Pedro and the Contramuelle Mollet, contract that has been modified in different occassions.

From 2015, the RCNP asked for the expansion of the phase and the extension of the concessional title to the protection of the Consolidated Text os the State's Ports Law and of the Merchant Marine. The APB settled the conditions due to which the extension should be given with the RCNP. However, the law complexity of the report motivated reports of the Ports of the Sate, the Advocacy of the State and the State Council, whose divergent interpretations derivated into a prolonged controversy and in the paralization of the expansion of the phase initiated by the APB.

In 2022 the club placed an administrative-contentious resource due to administrative silence before their requests. in November of 2025, the Balearics Superior Justice Tribunal delivered the sentence, estimated the resource and recognized their right to the expansion of phase and extension of the concession in the agreed terms with the APB.

After the sentence, and by the RCNP's petition, both parts have agreed on continuing the procedure to execute the error. In this context, and to avoid the interruption of the activity before the expiration of the operative AOT on Decembr 31st of 2025, the APB has decided giving a new temporary authorization while the processing of the definitive concessional title is completed.
