Justice agrees with the Real Club Náutico de Palma

The Balearics Superior Justice Tribunal explicitly points out that the club has the right to be given an "amplification of the times and an extension of the solicited concession, in the expected terms in the conditioned accord between the RCNP and the Balearics Portuary Authority, in March of 2019”.

The Administrative Litigation Chamber of the High Court of Justice of the Balearic Islands (TSJIB) has estimated the deman presented by the Real Club Náutico de Palma (RCNP) against the decision of the Balearics Portuary Authority (APB) of not answering to the request of amplifying the period of portuary concession. With this mistake, Justice recognizes the right of the club to preserve their current facilities.

The judicial mistake explicitly points out that the club has the right to be given the "amplification of the times and an extension of the solicited concession, in the expected terms in the conditioned accord between the RCNP and the Balearics Portuary Authority, in March of 2019”.

This judicial resolution represents excellent news for the sportive and recreational sailing, area in which the Real Club Náutico de Palma is an international referent. The club highlights their labour in sportive training and in values, the diffusion of Mallorcan maritime culture, the defense of social sailing and the organization of high-relevance events for the city of Palma.

The Chamber has estimated the RCNP's arguments by considering that their initial contract of services was tranformed into an assets concession when the State's Ports Law stopped considering the provision of those for the mooring management of recreational crafts. This way, the Tribunal has recognized that the club reunited all the necessary requirements to ask for and obtain a period amplification, in exchange for investments that will contribute to improving substantially the public-portuary space.

The Real Club Náutico de Palma has always trusted on the juridic reason to be on their side and wished to thank the care and support received during all this time on behalf of public institutions and civil society, of which it feels as an integrant part.

Rafael Gil, president of the RCNP, has seemed "very satisfied and relieved" by the decision of the TSJIB. He has reminded that, although there's a instability and an uncertainty lived from the expiration of the concession in December of 2022, the club has kept working "for the sport and the city", acting as a true platform of sea access and organizing important international events.

Gil has ensured that the Real Club Náutico de Palma "will keep its committment, with more force if possible", and has encouraged the members to feel proud of belonging to an institution whose values go back to the last decade of the 19th century and that face now "a promising future".
