Apanib reports the prohibition of private charter boat in the Balearics

The Pymes Association of Nautical Activities in the Balearics (Apanib) has presented an appeal before the Superior Tribunal of Justice of the Balearics against the Government's Decree that forbids touristic rental of private boats and that qualify as the “major threat in decades”.

In addition, according to a press release, Apanib has also presented a formal report before the Directorate General of the Marine Merchant asking for the immediate suspension of the conflictive precepts and a requirement to the Government for its derogation. 

In their views, the normative will cause massive cancellations, work loss, and clients runaways to other destinations and, “the most severe, it will put sea’s security into risk”.

According to them, the decree “discriminates” already established operators on the islands by forbidding charter by place, against the state law, and excludes operators by nationality or pavilion.

Equally, they have warned that “it puts lives into risk”, since “it alters the meaning of the international maritime signals, generating confusion and possible accidents”, and it "asphyxiates" the pymes and it “expels de facto” imposing requirements for the licenses “against” the legal normative of services in licenses, reinscriptions and taxes that choke competitiveness. 

They have also considered that it “endangers” privacy by imposing obligations of facilitating data, by their criteria, unnecessary for their control, and then publishing those companies' data “with no protection guarantee, spreading information that is considered business secret”.

“this case is not only a sectorial conflict, which it is, but also a juridical and political pulse of wide draft between the Balearic Government (PP) and the State (PSOE), which can create a historical precedent regarding the autonomic limits in the sea management”, they have highlighted  in a press release.
